1. Customer

Theraluxvet.fi is an online store maintained by Kuvistaa Oy (Business ID: 3528223-9) under the auxiliary business name Theralux.

Consumers, businesses, and organizations can be Theralux customers.

These terms and conditions apply to the commercial relationship between Kuvistaa Oy (Theralux) and its customers (hereinafter "Customer"). Terms concerning consumer trade apply to consumer customers, and the terms mentioned below apply to corporate customers (B2B).

Kuvistaa Oy reserves the right to update these terms and conditions without prior notice. Orders are subject to the terms and conditions valid at the time of order, which can be found on the online store's website.

2. Customer Relationship and Data Protection

When placing an order, the Customer must provide complete contact information: name, address, phone number, and email address. Corporate customers must also provide their business ID and a potential contact person.

Customer data is stored in Kuvistaa Oy's customer register, where the information is used to maintain the customer relationship. Data may be processed and disclosed in accordance with applicable legislation.

The privacy policy can be viewed on the online store's website.

Kuvistaa Oy has the right to cancel a transaction if the customer has provided incorrect information or acted inappropriately. Kuvistaa Oy alone has the right to interpret the aforementioned cancellation terms.

3. Product Selection

The Theralux online store sells laser therapy devices and related products. Availability information is based on announcements from manufacturers and importers. Kuvistaa Oy is not responsible for delays caused by reasons beyond its control (force majeure). Kuvistaa Oy alone has the right to interpret cases that qualify as force majeure situations.

Kuvistaa Oy reserves the right to restrict the sale of products if required by law or the product's intended use.

4. Delivery

Ordered products are delivered via a transport service using the customer's chosen delivery method. Delivery costs are determined according to the prices valid at the time of order and are indicated at checkout.

Generally, products in an order are delivered all at once. If not all products are immediately available, Kuvistaa Oy may deliver the order in multiple shipments at no additional cost to the customer.

5. Pricing and Payment Methods

All prices include the value-added tax applicable in Finland, unless otherwise stated. Delivery costs are added to the price at checkout.

Kuvistaa Oy reserves the right to cancel an order if there is such an obvious pricing error in the product that it can reasonably be assumed that the buyer also noticed it.

Available payment methods (e.g., online banking, card payment, invoice, and installment services) can be found in the online store. Payment method-specific terms are defined at checkout.

Payment Service Provider

Paytrail Oyj (2122839-7) acts as the implementer of the payment intermediation service and payment service provider in cooperation with Finnish banks and credit institutions. Paytrail Oyj appears as the recipient of the payment on the bank statement or card invoice and forwards the payment to the merchant. Paytrail Oyj has a payment institution license. In case of complaints, please primarily contact the product supplier.

6. Returns (consumers)

Consumer customers have a 14-day right of return in accordance with the Consumer Protection Act. The returned product must be unused, in its original condition, and carefully packaged.

The consumer is responsible for return costs unless the product is faulty. Any shipping costs are non-refundable if the product is returned.

When returning a product, the customer must present the order number or other proof of purchase. The refund will be made using the same payment method the customer used to pay for the order.

Restrictions on the right of return are determined in accordance with the Consumer Protection Act. For example, hygiene and intimate products do not have a right of return if the packaging has been opened. These include (but are not limited to) a treatment head suitable for dental care.

7. Warranty and Limitation of Liability

Products sold by Theralux have a manufacturer-defined warranty. The warranty covers manufacturing and material defects. Warranty terms are provided with the product or can be found on the manufacturer's website.

The warranty does not cover:

  • normal wear and tear
  • damage due to misuse or use contrary to instructions
  • damage caused by an animal's individual reaction to the treatment

Kuvistaa Oy is not responsible for indirect or consequential damages. By making a purchase decision, the Customer undertakes to be responsible for all matters related to and/or arising from the use of the device and undertakes to follow the operating instructions provided with the device.

8. Corporate Customers (B2B Terms)

The following terms apply to corporate customer orders instead of consumer terms:

  • Right of Return: Corporate customers do not have a right of cancellation or return under the Consumer Protection Act, unless specifically agreed otherwise.
  • Warranty: Products have a warranty granted by the manufacturer or importer. The seller's liability is limited to repairing or replacing a faulty product in accordance with the warranty terms.
  • Limitation of Liability: Kuvistaa Oy is not responsible for indirect damages, such as interruption of production, loss of income, or other financial losses.
  • Payment Terms: Unless otherwise agreed, the payment term is advance payment. In case of late payment, the current penalty interest and collection costs will be charged.
  • Ownership: Ownership of the products transfers to the customer only when the full purchase price has been paid.
  • Applicable Law and Disputes: Contracts between corporate customers are governed by Finnish law. Any disagreements will be resolved in the Central Finland District Court.

9. Dispute Resolution (consumers)

In the case of consumer customers, the parties primarily aim to resolve disagreements through negotiation. If an agreement is not reached, the consumer may refer the matter to consumer advisory services or the Consumer Disputes Board.

Kuvistaa Oy does not compensate for possible court or attorney fees, as consumer advisory services and the Consumer Disputes Board offer their services free of charge.
